What is a mental capacity assessment?
It is an assessment of an individual’s ability to make specific decisions in accordance with the legal tests set out in the Mental Capacity Act 2005, Banks v Goodfellow for testamentary capacity (making a will) and Re. Beaney for capacity to gift.

When should an older person have a mental capacity assessment?
For deputyship applications (COP3)
Making an advance decision / directive (living will). Mental capacity is a necessary requirement for the validity of an advance decision.
Making a lasting power of attorney (LPA) if there is any doubt about a person’s ability to make this decision/s, e.g. mild cognitive impairment or early dementia.
